Paternity

A paternity action is a court proceeding where a man is declared the biological father of a child. With an unmarried couple, the father can be determined in many ways. For example, by a blood test, or an official acknowledgement that he is the child’s father. Today, blood and DNA tests can affirmatively determine paternity with 99.99% accuracy and can rule out paternity with 100% accuracy. In the case of a married couple, unless there is a good reason, the husband will be presumed to be the biological father of the child.

A paternity action can be brought by either the mother or the father. If paternity is established, a Judicial Officer may order the father to pay child support and may grant him custody or visitation rights.
